Definitions. Multiple source drug means, with respect to a rebate period, a
covered outpatient drug for which there is at least one other drug product
which--

(3) Is sold or marketed in the State during the rebate period as
follows:
(i) A covered outpatient drug is considered sold or marketed in a
State if it appears in a published national listing of average wholesale
prices, selected by the Secretary, provided the covered outpatient drug is
generally available to the public through retail pharmacies in that State.
(ii) A covered outpatient drug is not subject to the FUL for a
rebate period if it is not a multiple source drug in the State for that rebate
period.
